§ 1 Scope
The Olive Track UG (hereinafter referred to as “the Organizer”) exclusively applies the following terms and conditions to all agreements with customers (hereinafter referred to as “participants”).
Deviating terms and conditions of the participant shall not become part of the contract unless expressly accepted by the Organizer in text form.
Amendments and supplements must be made in text form.
§ 2 Scope of Services
The Olive Track UG organizes guided motorcycle tours and provides, depending on the booked trip, especially the following services: organization and execution of the trip; tour guiding; creation and provision of roadbooks and navigation data; selection, booking and payment of accommodation; luggage transport and support vehicle assistance; support in case of breakdowns or vehicle issues within organizational limits; provision of catering according to the service description; welcome package.
The exact scope of services is defined exclusively in the respective trip description and booking confirmation.
Services not explicitly listed are not part of the contract. This includes in particular fuel, tolls, personal expenses, meals not included, insurance, and individual repair costs unless expressly agreed otherwise.
§ 3 Conclusion of Contract
The trips presented on the website or other media do not constitute a binding offer.
A contract is concluded only once the participant has made a booking and The Olive Track UG has confirmed it in text form (e.g. email).
Upon receipt of the booking confirmation, the contract becomes legally binding.
There is no entitlement to conclude a contract. For package tours with fixed dates, there is no right of withdrawal pursuant to § 312g (2) No. 9 BGB.
§ 4 Participation Requirements
Participation requires a valid motorcycle license, a legally registered vehicle or rental vehicle, valid third-party liability insurance (if using own vehicle), an official identification document, and acceptance of these terms.
Participants are responsible for ensuring compliance with all legal requirements in the countries visited.
The Organizer may exclude participants if requirements are not met or if safety risks arise.
§ 5 Third-Party Vehicles
If vehicles are provided by third-party suppliers, the rental agreement is concluded directly between the participant and the respective supplier.
The supplier is solely responsible for the technical condition and maintenance of the vehicles.
The Organizer assumes no liability for defects or damages arising from the use of third-party vehicles unless caused by its own fault.
§ 6 Payment
50% of the total participation fee is due upon booking confirmation, the remaining 50% no later than 6 weeks before departure.
Payment is considered fulfilled only upon receipt in the Organizer’s account.
In case of late payment, participants may be excluded from the trip.
§ 7 Entry and Participant Obligations
Participants are solely responsible for valid travel documents, visas, and compliance with entry requirements.
The Organizer provides information about the route but not about the procurement of documents.
§ 8 Changes and Cancellation
The Organizer may make minor changes to services if necessary, provided the overall character of the trip remains unchanged.
In case of significant changes, participants may withdraw from the contract.
In case of force majeure, the trip may be canceled. Payments already made will be refunded in accordance with legal requirements.
§ 9 Prices and Services
Prices and services are based on the respective trip description at the time of booking.
Included and excluded services are defined in the specific offer.
§ 10 Sponsorship and Branding
Participants may use their own sponsors, provided they are not presented as official partners without prior approval.
Use of the Organizer’s brand or logo requires written consent.
§ 11 Cancellation by Participant
Participants may cancel at any time in text form.
Cancellation fees apply as follows:
within 14 days after booking: free of charge;
up to 8 weeks before departure: 50%;
up to 6 weeks: 75%;
up to 2 weeks: 90%;
less than 2 weeks or no-show: 100%.
§ 12 Liability
The Organizer is fully liable for damages resulting from injury to life, body, or health, and in cases of intent or gross negligence.
In cases of slight negligence, liability is limited to essential contractual obligations and foreseeable damages.
§ 13 Photo and Video Material
Participants agree that photo and video recordings may be made during the trip and used for documentation and marketing purposes.
Usage rights are granted without restriction in time, territory, and content.
Consent may be revoked for future use; already published material remains unaffected where legally permitted.
§ 14 Payment Terms
50% upon booking, remaining 50% no later than 6 weeks before departure.
Payments are only considered complete once received in the Organizer’s account.
§ 15 Assignment
Assignment of claims requires written approval from the Organizer.
§ 16 Governing Law and Jurisdiction
German law applies. Jurisdiction is Berlin, Germany, where legally permissible.
§ 17 Severability Clause
If any provision of these Terms is invalid, the validity of the remaining provisions shall not be affected.
